Privacy Policy
Your privacy is important to us at Cahaba (“Cahaba”, “we”, or “our”). Accordingly, we have established and implemented information handling practices for [www.cahabadesigns.com] and our social media pages and apps on Facebook, Twitter and Pinterest (collectively with other social media apps and sites, now known or later developed, the “Sites”) that we believe are consistent with the highest standards and best practices of organizations doing business on the Internet. This Privacy Policy describes the practices that apply to our gathering of information from and about you through the Sites, including when and how we collect that information and what may happen to it. We have prepared this detailed Privacy Policy because we believe you should know as much as possible about our practices so that you can make informed decisions about how you use the Sites. Capitalized terms in this Privacy Policy have the meaning ascribed to them in the Terms of Use.
When You Visit the Sites
You can always visit the Sites without revealing who you are or providing any personal information. When you visit the Sites, we do collect usage information, but it is anonymous and is not linked to you as an individual. We may use this data to better understand, for example, how the Sites are navigated, how many visitors arrive at specific pages, the length and frequency of stays at the Sites, the types of browsers and computer operating systems used by our visitors and the Internet Protocol addresses from which our visitors connect to the Sites. We may use this information to improve the Sites’ content and ease of use.
How We Collect Personally Identifiable Information
We will collect personally identifiable information about you, such as your name, postal address, telephone and mobile numbers, email address, profile pictures, or social media IDs when you voluntarily provide it to us through the Sites, such as when you create an account or profile; register a product; order literature; enter sweepstakes, contests or incentive programs; sign up for newsletters; participate in a survey; submit a product review; contact customer service; or otherwise provide information to the Sites. In addition, we may receive your personally identifiable information from other sources, such as public databases; joint marketing partners; social media platforms; and people with whom you are friends or otherwise connected on social media platforms, as well as from other third parties. For example, if you elect to connect your social media account to an account you have with us, certain personally identifiable information from your social media account will be shared with us, which may include personally identifiable information that is part of your profile or your friends’ profiles.
Security
The Sites have security measures in place to protect against the loss, misuse and alteration of the information under our control. We safeguard the security of the data you send us with physical, electronic, and other procedures. However, it is not possible to guarantee the security or integrity of information disclosed online. Because no data transmission over the Internet is completely secure, we urge you to take every precaution to protect your personal data when you are on the Internet, including when you are using the Sites.
How We Use Personally Identifiable Information
We will take all reasonable efforts to protect your personally identifiable information, and we will not share it with third parties, such as direct marketers, without your request or consent. However, you acknowledge and agree that we or our authorized agents may provide your personal information (a) to third-party providers of services to the Sites, such as computer programmers, technicians and sweepstakes management companies, (b) to third parties associated with our products, such as our authorized dealers, to assist you with your questions or requests, (c) to other third parties when compelled by a court order or other legal process, and (d) to third parties that enter into certain agreements with us, such as an assignment, sale, joint venture or other transfer or disposition of a portion or all of our Sites, or our assets, business or stock. With respect to (a), (b) and (d) above, we will provide your information only to third parties that are under obligation to reasonably protect this information.
The personally identifiable information we collect from you may be used by us and our third-party partners for “remarketing” purposes, which means you may see our ads appearing from time to time on other websites that you visit. We may also contact you by email, regular mail, fax, text message or telephone from time to time with information about our new products and Sites, special offers, upcoming events and changes to the Sites. Each communication you receive from us will provide you the opportunity to opt out of receiving further communications.
Additionally, we reserve the right to share with other users of the Sites and with our dealers and third-party partners any personally identifiable information you share with your friends (i.e., public information) via any of your social media accounts. In addition, if you post on our website a review of one of our products, we will give you the opportunity to link your social media profile to your review, so you may link pictures, including your profile image, from your profile to your review. By connecting your social media profile to your review, you authorize us to share information with our other Site and social media users. If you do not want your personally identifiable information shared with other users, please do not connect your social media account to your review and do not participate in social sharing on the Sites.
How We Collect and Use Other Information
Cookies; Pixel Tags – We or our authorized agent may place a “cookie” or “pixel tag” on your computer when you use one of the Sites. These are small computer files that our computer sends to your computer and that your computer sends back to us each time you visit the Site. We may use these devices to collect data to help us personalize and improve your experience on the Sites, or for advertising purposes, including remarketing. Most Internet browsers automatically accept cookies. However, you can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the sites you visit. If you decide not to accept our cookies, your ability to use some features on the Sites may be impaired because our computer and apps will not automatically recognize yours.
Google Analytics – We use Google Analytics, a Google service that uses cookies and other similar technologies to collect information about use of the Sites anonymously and report trends, without identifying individual users. We also use an enhancement to Google Analytics called “Demographics and Interest Reporting,” through which Google provides us with information about our users’ demographics (e.g., age and gender) and interests. This information, which Google may collect by tracking a user’s behavior across third-party websites, helps us to learn more about our users. You can learn about Google’s practices in connection with this enhanced tracking and opt out of it by visiting www.google.com/settings/ads or by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.
IP Address – Your “IP Address” is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP Address may be identified and logged automatically in our server log files whenever a user accesses the Sites, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice and is done automatically by many websites and applications. We use IP Addresses for purposes such as calculating usage levels of the Sites, helping diagnose server problems, administering the Sites and identifying your device’s physical location.
Links to Other Websites
Our website may contain links to other websites. Please note that we are not responsible for the privacy practices of other websites. We encourage you to be aware when you leave our website and to read the privacy statements of every website that collects personally identifiable information. Our Privacy Policy applies solely to information collected by the Sites and does not cover information collected elsewhere.
User Generated Content Functions
Certain pages on the Sites, including our social media pages, may enable users to create their own profile page or submit their own content, which may include open forums, reviews section, question and answer section, chat functionality and blogs, among other services. Any information you disclose in such a profile page or submission may be publicly available and be read, collected or otherwise used by anyone who visits the URL of the page on which you have chosen to comment, and you should exercise caution in deciding whether to disclose your personal, financial or other sensitive information there. We cannot prevent such publicly-available information from being used by others in a manner that may violate our Privacy Policy, the law or your personal privacy and safety, and we are not responsible or liable for the results of any postings or the use or disclosure of any information that you disclose via such postings.
Choice: Opt-Out
If you do not wish to receive marketing-related emails from us, or if you would prefer that we do not share personally identifiable information as described in this Privacy Policy, you may opt out of receiving such marketing-related emails and from such sharing by following the instructions at the bottom of each email you receive from us or by sending an email (from the email address to which you’re receiving marketing-related emails) to [[email protected]] with the subject line “unsubscribe”. We will endeavor to comply with your request as soon as we can. Please note, however, that we will not be able to remove personally identifiable information about you from the databases of third parties who have received your information as permitted by this Privacy Policy. If you wish to cease receiving marketing-related emails from third parties, please contact them directly or use the opt-out mechanisms set forth in their respective privacy policies or marketing-related emails.
California Privacy Rights
Pursuant to California Civil Code § 1798.83, a California resident who has provided personal information to a business with which he/she has established a business relationship has the right to request from that business information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. In general, if the business has made such a disclosure of personal information, the business is required to provide a list of all third parties to whom such personal information was disclosed in the preceding calendar year, as well as a list of the categories of personal information that were disclosed, upon receipt of a request by a California resident. However, under the law, a business is not required to provide the above-described lists if the business adopts and discloses to the public (in its privacy policy) a policy of not disclosing personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of personal information and providing a cost free means to exercise that right. As noted above, we do not disclose such personal information to third parties for direct marketing purposes unless you affirmatively agree to such disclosure.
